6/1/2020 – Since the 2018 Farm Bill was signed into law, the Food and Drug Administration (FDA) has said that it has authority under the Federal Food, Drug, and Cosmetic Act (FD&C Act) to regulate food products and dietary supplements that contain CBD, as well as other products that contain CBD that make health claims. This extends to health claims made about CBD products and their ability to treat or prevent COVID-19. At this time, there are no hemp products that have been approved by FDA for these purposes. Statements making such claims are viewed by the FDA to be false or misleading, in violation of the FD&C Act.

The agency has issued warning letters to companies that make false or misleading claims about hemp and hemp-derived CBD products, and is evaluating company websites as well as the label on the products themselves. If companies do not comply with the terms of the warning letters and remove these claims, the FDA may take further action, including the seizure of products and/or an injunction against the company to stop them from selling such products.
